Town Board Meeting Minutes

 

 

 

May 2, 2022

Chairman Monsen called the meeting to order at 6:30 p.m.  Also present were Supervisor Ted Olson, Supervisor Daniel Jenks, Constable Greg Holte, Treasurer Bonnie Smithback, and Clerk Melanie Huchthausen.  See attached sign-in sheet for others present. 

 

1.      Welcome and Pledge of Allegiance.  The Pledge of Allegiance was led by Veteran Jack Lyon. 

 

2.      Approval of Agenda.  Supervisor Olson stated a motion to approve the agenda as presented.  Motion was seconded by Supervisor Jenks.  Motion carried 3-0. 

 

3.  Minutes: Chairman Monsen asked if everyone read the minutes.  Supervisor Jenks stated a motion to approve the minutes of the regular meeting of April 18, 2022.  Motion was seconded by Supervisor Olson.  Motion carried­ 3-0.    

                                

4.  Report on Bills:  Supervisor Olson stated a motion to accept and approve the bills payable in the amount $31,548.42. Motion was seconded by Supervisor Jenks.    Motion carried 3-0.

 

5.  Public Comment:     We have been asked by a resident to participate in No Mow in May.  The Board recommends the Road Crew do one pass in May and the usual mowing in the fall. 

 

6.  Treasurer’s Report.  Treasurer Smithback gave the treasurer's report, a copy of which is attached and made a part of these minutes.  Supervisor Jenks stated a motion to approve the Treasurer’s Report.  Motion was seconded by Supervisor Olson.    Motion carried 3-0.

    

7.  Clerk's Report:   Clerk Huchthausen gave the clerk's report, a copy of which is attached and made a part of these minutes.  Supervisor Olson stated a motion to approve the Clerk’s Report.  Motion was seconded by Supervisor Jenks.    Motion carried 3-0.

 

8.  Road Crew:  They are replacing culverts in advance of the County repairing Highway N.      

 

9.  Constable Report:  (1) Holte called the complainant on Spring Road, without a response.  (2) He had a complaint of a dog running on Taylor Lane.  Contact has made with the potential owner and follow up will be made. 

 

10.  Plan Commission Report:  The Plan Commission met last month and a motion was made to amend the Comprehensive Land Use Plan. 

 

11.  Rural Preservation Commission Report.  The Commission continues to meet now once a month. They have contacted the land owners who they recommended to the Town Board.  They have hit a road block which affects their process going forward.  The road block is a difference of opinion as to what happens with the development rights once purchased from the landowner.  The current concept is that the development rights go away once purchased from the town.  Another option that has come up is that the town sells the splits at a later date.  The majority of the commission feels that selling of the splits at a later date is a serious concern.  Springfield does a transfer of development rights program.  They believe what Dunkirk has set up is a purchase of development rights program which extinguishes the development rights.  One of the landowners that the Commission has met with have specifically stated they will not send their land if the splits are sold.  Chairman Monsen stated there have been previous discussions regarding splits and it was his understanding the splits would disappear.  Since that time, another township has begun a program that allows for transfer of development rights.  The Town Board has investigated a transfer of development rights program.  Plan Commission Chairman Bill Delehanty stated perhaps a transfer of development rights program happens separate from the Rural Preservation Program.  The Rural Preservation Commission members believe the Rural Preservation Program should be separate from a potential transfer of development rights program.  Supervisor Olson stated from day one the purpose of the Rural Preservation Program was to preserve farm land.  Any transfer of development rights program would not take up farm land.   Supervisor Jenks stated he apologized for any actions that would jeopardize the Rural Preservation Committee’s work to date.   Chairman Monsen stated the Town wants to have the best agricultural land preservation in the State, while having the tax basis to continue to provide goods and services to the residents.   Rural Preservation Committee members asked that the Board specifically state that the development rights purchased through the Rural Preservation Program, once purchased from the landowner, be extinguished and not allowed to be sold or transferred by the Town Board. 

 

12.  Complaints:      None.

 

13.  Unfinished Business: 

 

a.     Discussion and necessary action on amending the Town’s Land

Use Plan.   Supervisor Jenks stated a motion to affirm the direction of the Rural Preservation Program and any splits purchased through this program with Groundswell are extinguished.  Motion was seconded by Supervisor Olson.  Motion carried 3-0.    The Clerk has forwarded a draft Resolution to Plan Commission Chairman Bill Delehanty to amend the maps at this time as it relates to commercial zoning on McComb Road.  Supervisor Olson stated a motion to amend the maps in the Land Use Plan.  Motion was seconded by Supervisor Jenks.  Amending the maps will not guarantee a commercial property be allowed.  Supervisor Jenks stated a motion to table the Motion.  Motion was seconded by Supervisor Olson.  Motion carried 3-0. 

 

b.     Discussion and necessary action on updating Town’s Employee

Handbook.  The Board has made changes to the Town Employee Handbook and have returned to Luann Alme to amend.  No action taken.   

 

c.     Discussion and necessary action on Brush Site Agreement with

the City of Stoughton.  Supervisor Olson stated a motion to sign the Brush Site Agreement with the City of Stoughton.  Motion was seconded by Supervisor Jenks.  Motion carried 3-0. 

 

d.    Discussion and necessary action on County repairs to Highway N

in 2022.  The County hosted a public information meeting and advised the Board and residents that they plan to overlay Highway N in 2022. 

 

e.    Discussion and necessary action on awarding 2022 Road bids.

The Board opened bids on April 28, 2022, and awarded the seal coat bid to Fahrner.  No overlay bids were awarded. 

 

14.    New Business:

 

a.    Discussion and necessary action on signing U.S. Department of

Agriculture and Natural Resources Conservation Service Entity Application for a Regional Conservation Partnership Program Entity-Held Easement Program Agreement.  Renee Lauber stated this is the agreement with NCRS.  This is not specific to a property but allows for funds for the Rural Preservation Program.  Supervisor Olson stated a motion to sign the U.S. Department of Agriculture and Natural Resources Conservation Service Entity Application for a Regional Conservation Partnership Program Entity-Held Easement Program Agreement.  Motion was seconded by Supervisor Jenks.  Motion carried 3-0.   

 

15.  Future agenda items. 

 

16.  Adjournment:   No further business, Supervisor Jenks stated a motion to adjourn the meeting at 9:03 p.m.  Motion was seconded by Supervisor Olson.  Motion carried 3-0.
