Town Board Meeting Minutes
January 2, 2024
6:30 PM
Dunkirk Town Hall

Chairman Monsen called the meeting to order at 6:34 p.m. Also present were Supervisor Olson, Supervisor Jenks, Constable Holte, Treasurer Bonnie Smithback and Clerk Kathy Olson. See attached sign-in sheet for others present.
1. Welcome and Pledge of Allegiance. The Pledge of Allegiance was led by Constable Holte
2. Approval of Agenda. Supervisor Olson stated a motion to approve the agenda as presented. Motion was seconded by Supervisor Jenks. Motion carried 3-0.
3. Minutes: Chairman Monsen asked if everyone read the minutes of the regular meeting of December 18, 2023. Supervisor Olson stated a motion to approve the minutes as presented, Supervisor Jenks seconded. Motion carried 3-0
4. Report on Bills: Supervisor Olson stated a motion to accept and approve the bills, approved payable amount is $38,111.95. Motion was seconded by Supervisor Jenks, Motion carried 3-0.
5. Treasurer Report – Bonnie presented the December financial report, Supervisor Jenks made a motion to approve, Supervisor Olson seconded. Motion carried 3-0
6. Public Comment: - Discussion between Perla Asphalt Maintenance and the residents surrounding the business site. After much discussion it was determined that Perla will keep agreed upon hours for the next few weeks until there can be a meeting set up between the board, the owner of the property and others. Those agreed upon hours will be 7:00am to 7:00pm Monday thru Friday, Saturday 11:00am to 3:00pm. However, during snow plowing, hours will be early, but Perla will try their best to reduce noise. It was pointed out that there are several tenants on this property and all should be accountable for disrupting the neighborhood.
7. Clerk's Report: Clerk Olson gave her Clerk’s report, a copy of which is attached and made a part of these minutes. Supervisor Olson stated a motion to approve, Supervisor Jenks seconded. Motion carried 3-0
8. Road Crew: Chairmen Monsen spoke on behalf of road crew, cutting down trees and hoping for a little snow
9. Constable Report: None
10. Plan Commission: At December meeting - Jerry King can’t do a TDR due to its only available to a landowner to transfer a building permit within their own property. Also, would like board to go look at a rezone for a driveway it is around 300’.
11. Rural Preservation Report: USDA wet land agreement, have a landowner who wants land protected.
12. Parks Committee: Meeting Jan 4th, also having a zoom meeting with a playground equipment company for Ash Lane
13. Complaints: none
14. Unfinished Business:
a. Consider portion of Hanerville Road right-of-way width for adjacent Parcel #: 026/0511-352-8010-4, Chris Luzzio 249 Hanerville Road. Received e-mail from Chris asking if we could still keep on agenda.
b. ATV –
14. New Business:
a. Adoption of Residential & Commercial Building codes – Steve Kittleson will be attending the next meeting to go over codes.
b. Date for Quad Towns meeting – Will determine a date next meeting
c. Ordinance Amendment 2023 OA-068 regarding CUP & rezoning processes – All board members agreed the amendment should be approved. Supervisor Olson made a motion to approve Ordinance Amendment 2023 OA-068, Supervisor Jenks seconded. Motion carried 3-0
15. Future agenda items.
a. Discussion on adopting a stricter noise ordinance
16. Adjournment: No further business, Supervisor Jenks stated a motion to adjourn the meeting at 7:56 p.m. Supervisor Olson seconded. Motion carried 3-0.
